The committee claims that the "Secret Panel" convened by the Department of Health and Human Services (HHS) and the U.S. Department of Agriculture (USDA) disregarded established federal laws requiring transparency and balance in dietary recommendations. Neal D. Barnard, MD, president of the Physicians Committee, criticized the government’s actions, stating, "They put money in the industry's pocket and cholesterol in Americans' arteries."

Typically, the Dietary Guidelines are based on a scientific report prepared by an independent Dietary Guidelines Advisory Committee (DGAC) formed under the Federal Advisory Committee Act (FACA). In December 2024, the DGAC concluded its two-year public process, producing recommendations that advocated for increased plant-based food consumption and a preference for water over milk.

Instead of adopting these recommendations, however, HHS and USDA allegedly replaced them with those from the hastily created Secret Panel, which was dominated by individuals with conflicts of interest involving meat and dairy organizations. Of the nine panel members, eight had ties to entities such as the National Cattlemen’s Beef Association and the National Dairy Council.

The lawsuit highlights that the Secret Panel produced a report in just three months, which was only made publicly available alongside the guidelines’ release date. The complaint raises concerns about the potential health risks posed by the guidelines, particularly to children and individuals with health issues who may follow the faulty advice it contains.

The Physicians Committee seeks a court order to withdraw the Dietary Guidelines and prevent HHS and USDA from using them in future decisions while new guidelines are developed in accordance with FACA. Dr. Barnard emphasized that the influence of industry on dietary recommendations undermines the integrity of federal food programs like the National School Lunch Program, WIC, and SNAP.
